The petitioners have preferred this application for grant of regular bail in a case registered under sections 457 and 380 of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that he received information about the shutter of his shop having been broken. On reaching his shop it transpired that gold and silver ornaments worth Rs.15-16 lac had been stolen. Patna High Court CR. MISC. No.22701 of 2022(4) dt.11-01-2023 2/2 were allegedly caught selling the stolen jewellery. No incriminating article has been recovered from the petitioners' possession and the jewellery recovered has not been put on T.I. Parade. The petitioners are in custody since 3.1.2022. Heard learned A.P.P for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation and the material which has transpired in course of investigation, the stolen jewellery allegedly recovered from the petitioners' possession not having been put on T.I. Parade and the petitioners having been remained in custody for 1 year since 3.1.2022, the petitioners are directed to be enlarged on bail in connection with Gaya Mufassil P.S. Case no. 514 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
