ANJANA MISHRA ORAL ORDER 09-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Goraul (Kathara O.P) P.S. Case No. 45 of 2012 registered for the offences punishable under Sections 467, 468, 471, 409 and 420/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that initially, the first information does not disclose the name of the petitioner and no specific role is assigned in the disbursement of money in the Manrega scheme. It is further submitted that the entire operation has been conducted by the Mukhiya and the Panchayat Rozgar Sewak and the petitioner has no role to play whatsoever. Further, the disbursement made, does not bear the

Patna High Court Cr.Misc. No.49952 of 2014 (2) dt.09-04-2015 signature of this petitioner but due to some ulterior motive, the petitioner's name has come in the present case. Considering the aforesaid submissions and the fact that petitioner's name surfaced about after two years of the lodging of first information report, let the petitioner above named , in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul (Kathara O.P) P.S. Case No. 45 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. '
