JUSTICE MUNGESHWAR SAHOO ORAL ORDER 14-10-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner, namely, Rajesh Yadav apprehends his arrest in Barauli(Madhopur O.P.) P.S. Case No.103 of 2015 under Sections 341, 323, 307, 379, 427, 504/34 of the Indian Penal Code.
The learned counsel for the petitioner submitted that the parties are next door neighbours. There is land dispute between the parties and a counter case has been filed by the petitioner's party also against the informant's party. Both the parties have received injuries. The injury report has been annexed as Annexure 3 and 4 respectively.
The learned A.P.P. did not dispute this fact.
Patna High Court Cr.Misc. No.42161 of 2015 (2) dt.14-10-2015 Considering the above facts and circumstances of the case that there is land dispute between the parties and the parties are next door neighbours and there are cases and counter cases , I direct the petitioner named above to surrender before the court below within six weeks from today and on his so surrendering, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Pandey, learned Judicial Magistrate Ist Class, Gopalganj in connection with Barauli(Madhopur O.P.) P.S. Case No.103 of 2015.
