JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Bihpur P.S. Case No. 136 of 2015, registered under Sections 302, 201 and 120(B) of the Indian Penal Code. The accusation is that, on 17.05.2015, in the morning, Nitish Kumar, son of the informant, moved from his house but he did not return. On next day, in course of search, the dead body of son of the informant was found on the bank of river Ganga. The informant came to know that before five days his son, Nitish Kumar, was standing on the bank of river Ganga and urinating where petitioner made protest and threatened of dire consequences due to that reason, Munna Manda and Dharba Mandal have

Patna High Court Cr.Misc. No.17209 of 2017 (4) dt.13-07-2017 committed the murder of his son by pressing his neck. Learned counsel for the petitioner submits that petitioner, who is the lady, has falsely been implicated in this case mere on suspicion whereas nothing has been collected by the Investigating Officer against her.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Naugachia, Bhagalpur, in connection with Bihpur P.S. Case No. 136 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
