The petitioner apprehend his arrest in connection with Bachhwara P.S. Case No. 126 of 2018 registered under Sections 147, 148, 149, 448, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Six accused persons including the petitioner are said to have intruded into the house of the informant and started hurling abuse and on protest, co-accused Hiralal Rai resorted firing upon the right knee of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case. Petitioner happens

Patna High Court CR. MISC. No.25502 of 2019(2) dt.19-04-2019 2/2 to be Shadhu of the informant. He does not happen to be assailant rather assailant is Hiralal Rai. Though the said accused is said to have resorted firing upon right knee of the informant, but injury was found lacerated caused by hard blunt substance and said Hiralal Rai has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 21.02.2019 passed in Cr. Misc. No. 679 of 2019. Petitioner has no criminal antecedent. On the other hand, learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Bachhwara P.S. Case No. 126 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
