Petitioner seeks bail, who is in custody since 06.03.2018 in connection with Sessions Trial No. 144 of 2018 arising out of Nawanagar (Sonbarsa) P.S. Case No. 203 of 2017, F.I.R. dated 27.12.2017 registered for the offences punishable under Sections 341, 323, 326, 307, 498A of the Indian Penal Code and later on Section 304(B) of the Indian Penal Code was added.

Learned counsel for the petitioner submits that earlier the bail petition of the petitioner was rejected vide order dated 14.03.2019 passed in Cr. Misc. No. 72179 of 2018. Vide order dated 22.05.2023, a report was called for with regard to the stage of the trial. Report dated 30.05.2023 of

Patna High Court CR. MISC. No.21335 of 2023(3) dt.13-07-2023 2/2 the learned Trial court reveals that out of seven chargsheeted witnesses, six witnesses have already been examined and the only one witness i.e. Investigating Officer has been examined partly and the case is pending for the evidence of P.W.7 (Investigating Officer).

Considering the aforesaid facts and in view of the report of the learned Trial court, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 144 of 2018 arising out of Nawanagar (Sonbarsa) P.S. Case No. 203 of 2017 pending in the Court of learned Additional Sessions Judge 1st, Buxar.

Prayer is refused.

However, the learned Trial court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U T
