JUSTICE SHIVAJI PANDEY ORAL ORDER 18-08-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 456 of 2019 registered for offence punishable under section 379 of the Indian Penal Code.
This Court, vide order dated 27.11.2019, in Cr. Misc. No. 77133 of 2019 rejected the bail of the petitioner with the observation that he can renew his prayer for bail after eight months of custody.
The counsel for the petitioner submits that the petitioner has completed more than eight months in custody and one year is going to be completed on 31.08.2020. Looking to the entire facts and circumstance of the
Patna High Court CR. MISC. No.22182 of 2020(2) dt.18-08-2020 2/2 case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 456 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
