JUSTICE SATYAVRAT VERMA ORAL ORDER 26-11-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in connection Excise Case no. 97 of 2021 registered for the offence punishable under sections 30(a) and 37(b) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 27.02.2021 and is person with clean antecedent and charge sheet has been submitted. No.31180 of 2021(2) dt.26-11-2021 2/2 the allegation as alleged in the FIR, it would manifest that it is alleged that 09 liter Indian made foreign liquor and 30 liter toddy were recovered from the house of Ashok Paswan and against this petitioner, it is alleged that he had consumed alcohol.

Learned APP opposed the prayer for bail.

Considering the facts that petitioner is in jail custody since 27.02.2021 and is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Muzaffarpur in Excise Case no. 97 of 2021.
