This application has been filed for quashing the order dated 6.7.2002 passed in G.R. No.728 of 1998, arising out of Kotwali Munger P.S. Case No.228 of 1998 by the Chief Judicial Magistrate, Munger by which he has taken cognizance against the petitioner for offences under Sections 341, 323, 353 and 504/34 of the Indian Penal Code. Allegation has been made that the informant at the relevant time was posted as Physician in the hospital. On the fateful day at about 5 P.M. one Rakesh Mohan Bharti was admitted in the hospital for treatment. The informant was called and examined the patient, the condition of the patient

Patna High Court Cr.Misc. No.16608 of 2013 (3) dt.21-05-2015 was declared before his attendant. In the meantime petitioner along with Sunil Kumar Singh and Munna Singh were talking for the treatment of the patient in another hospital whereupon the informant referred the patient to Medical College, Bhagalpur and petitioner asked the informant to send a doctor with the patient for his proper care and treatment but the informant advised him to arrange an outside doctor for his treatment. Thereafter the petitioner and other accused persons started putting pressure on him, ultimately threatened and abused him. Thereafter Sushil kuamr Singh and Bhajami Singh came with gun and rifle and started giving threatening to his life and ransacked entire hospital. The trial court on the basis of the material available on record has taken cognizance against the petitioner. This Court does not find any error in the impugned order.

Accordingly this application is dismissed.
