JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This is an application for grant of anticipatory bail in connection with Rajpur P.S. Case No. 205 of 2018, disclosing offences under Sections 376, 504, 506/34 of the Indian Penal Code and Section 4 of the POCSO Act.
Prosecution story is that son of the petitioner try to commit rape upon the daughter of the informant and when he made complaint about the same to the petitioner, he abused him and also threatened him. It further appears that the petitioner is accused in two other cases.
Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the allegation of try to commit rape is not against him. Heard learned A.P.P. also.
Having heard both sides, considering the fact that the
Patna High Court CR. MISC. No.20638 of 2019(2) dt.08-05-2019 2/2 allegation of try to commit rape is not against this petitioner, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 1st cum Special Judge, Buxar, in connection with Rajpur P.S. Case No. 205 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
