The petitioner is in custody since 27.08.2016 in connection with Thawe P.S. Case No. 116 of 2016 registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code and Section 7 of the E.C. Act.

Counsel for the petitioner submits that he is merely the Khalasi of the truck which is alleged to be fleeing with certain Jute and Plastic bags containing wheat. The petitioner has nothing to do with the carriage of such items as he is merely the Khalasi of the truck.

In view of the aforementioned facts and that the petitioner has clean antecedent, let the above named petitioner, be
