JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(a) of Bihar Excise Act. In huge quantity country made liquor are said to have been recovered from the house of the petitioner and taking note of the aforesaid fact, the prayer for bail of the petitioner was rejected by this court but submission on behalf of the petitioner is that the present case was lodged against the petitioner as well as his son and the son of the petitioner has already been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 29.07.2016 passed in Cr. Misc. No. 27854 of
Patna High Court Cr.Misc. No.50773 of 2016 (2) dt.07-12-2016 2/2 2016 but the aforesaid fact could not be placed before this court at the time of passing order dated 07.09.2016 in Cr. Misc. No. 37326 of 2016.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Siwan in connection with Complaint Case III (C III) No. 29/2015.
