The petitioners apprehend their arrest in Ramgarhwa P.S. Case No. 117 of 2016 instituted for the offence under Section (s) 147, 149, 341, 323, 152, 153, 153(A), 295(A), 307, 332, 333 of the Indian Penal Code.
It has been submitted that there is general and omnibus allegation against these petitioners. The occurrence has taken place on 12.10.2016 and the case has been registered on 15.10.2016 after delay of three days.
From the written report, it appears that there is general and omnibus allegation against the petitioners that on the
Patna High Court Cr.Misc. No.7511 of 2017 (3) dt.02-03-2017 2/2 occasions of Muharram the petitioners tried to cause communal disharmony.
It has been mentioned in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Ramgarhwa P.S. Case No. 117 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Raxaul at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
