=========================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL JUDGMENT Date: 14-02-2017 The petitioner claims death-cum-retiral benefits i.e. gratuity, Provident Fund, Group Insurance amount, Leave Encashment etc. on account of death of his uncle Bindhyachal Mishra, who was an employee of the respondent's department. In the show-cause filed, it has been pointed out that the deceased employee was unmarried as per records available with the Board and that petitioner has to produce the succession certificate granted by the competent court of law before the terminal benefits are paid to the petitioner.

Patna High Court MJC No.2209 of 2004 dt.14-02-2017 2/2 In view of the said fact, the present Contempt Petition is disposed of with liberty to the petitioner to establish his right to claim terminal dues of the deceased employee from the competent court in accordance with law.
