The petitioner is accused in connection with Special (Excise) Case No. 478 of 2018 arising out of Nauhatta P.S. Case No. 146 of 2018 registered under Sections 30A, 38(i) and 41(i) of the Bihar Excise Act, 2016.

The accusation is of recovery of 144 bottles, each containing 375 ml, Indian made foreign liquor from possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 12.09.2018.

Having regard to the facts and the circumstances of

No.71336 of 2018(2) dt.04-12-2018 2/2 the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Saharsa, in connection with Special (Excise) Case No. 478 of 2018 arising out of Nauhatta P.S.
