JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-12-2017 Heard the learned counsel for the petitioners, the learned counsel for the State and learned counsel for the informant.
The petitioners apprehend their arrest in connection with Sadar P.S. Case No. 81 of 2017, registered for the offences punishable under Sections 467, 468, 471, 420 & 406 of the Indian Penal Code.
In this case the matter was referred to Mediation Centre, Patna High Court and the learned Mediator has submited his report stating that the dispute between the parties has been resolved through the process of mediation, the terms of settlement mutually agreed upon by them has been attached with the
Patna High Court Cr.Misc. No.20075 of 2017 (4) dt.12-12-2017 2/2 Mediator's report. Both parties also agree in the Court that the dispute between the parties has been settled amicably and now the informant has got no objection if pre-arrest bail is allowed to the petitioners and, as such, the petitioners deserve sympathetic consideration.
The learned A.P.P. has also got no objection in view of the settlement.
In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No. 81 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
