JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 The present application has been filed for modification of the order dated 14.02.2012 passed in Cr. Misc. No. 447 of 2012 to the extent that the money deposited by the O.P. No. 2 to the extent of Rs. 1,50,000/- be released in favour of the petitioner since the trial has not concluded in spite of observation of the Court that the trial may be concluded within a period of one year.
It is submitted by learned counsel for the O.P. No. 2 that charges have been framed and two witnesses have already been examined.
In the circumstance, it is expected from the learned Trial Court to conclude the trial preferably within a period of eight months.
Accordingly the modification application is
Patna High Court Cr.Misc. No.1573 of 2014 (5) dt.19-08-2015 2/2 disposed of in connection with East Colony P.S. Case No. 34 of 2010, pending in the Court of learned Chief Judicial Magistrate, Munger.
