The petitioner is apprehending arrest in a case registered for the offences punishable under Sections of the Indian Penal Code.
The prosecution case is that in the night of 02.09.2014, the informant along with his son and nephew were sleeping in a room at the third floor of Sukhdeo Mukhilal College, Hajipur at 03.00 am, the informant woke up on the noise and saw 8-10 miscreants breaking the lock of main gate while some miscreants entered in the campus by escaping the boundary wall when the petitioner, co-accused Vinod Chaudhary, Rameshwar Chaudhary, Gopal Sah and Vinod Sah started assaulting the informant. Patna High Court Cr.Misc. No.45187 of 2015 (2) dt.03-11-2015 2/2 assaulted with iron rod on the head of the informant and thereafter he indiscriminately assaulted the informant by iron rod when his son Rituraj and nephew Rishiraj came to rescue they were also assaulted.
It is submitted by learned counsel for the petitioner that with regard to some of the injuries the opinion has been kept reserved and in the background petty dispute the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Hajipur Town P.S. Case No.757 of 2014, pending before the learned CJM, Vaishali at Hajipur.
With the above observation, this application is, accordingly, disposed off.
