The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419/420/406/409/120B of the Indian Penal Code. Allegation is that from the provident fund account of the informant Rs.9,00,000/- was withdrawn under conspiracy and forgery.
Submission of the petitioner is that main accused Suman Kant Sinha was already sent to jail. He was kingpin in committing forgery from different provident fund accounts including of the petitioner, who was posted as Medical Officer there at. Annexure-2 revealed that money from the provident fund
Patna High Court Cr.Misc. No.12860 of 2017 (3) dt.10-05-2017 2/2 account of the informant was withdrawn and deposited in the bank account of Suman Kant Sinha.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Danapur, Patna/Successor Court in connection with Paliganj Police Station Case No.131 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
