Mr. Sri Parmanand Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 The petitioner seeks bail in connection with Dhamdaha P.S.Case No. 204 of 2018 registered under Sections 379,411 and 420/34 of the Indian penal Code.
Allegation, as per the FIR, is that motorcycle of the informant was stolen away and later on, he came to know that the petitioner and one Vikash Kumar Mehta were going on that stolen motorcycle for selling goat at Kukara and the accused persons, abandoning the motorcycle there, fled away. Submission of learned counsel for the petitioner is that nothing has been recovered from the conscious possession of the petitioner, he has no criminal antecedent and is in custody since 29.08.2018 and other accused, namely, Vikash Kumar Mehta, having similar allegation, has been granted bail by a coordinate Bench of this Court vide order dated 27.11.2018 passed
Patna High Court Cr.Misc. No.69172 of 2018(2) dt.04-12-2018 2/2 in Cr. Misc. No. 68266 of 2018.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Dhamdaha P.S. Case No. 204 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
Learned counsel for the petitioner is permitted to do necessary correction in para-13 of the petition. (Vinod Kumar Sinha, J) sujit/- U T
