JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Wajirganj P.S. Case No. 341 of 2014 registered for the offence under Section-307 & other minor sections of the Indian Penal Code.
Taking into consideration that altogether four persons sustained injury and one injured got grievous injury on her head, I do not feel it proper to extend the privilege of anticipatory bail to petitioners and accordingly, their prayer for anticipatory bail in connection with Wajirganj P.S. Case No. 341 of 2014 pending in
Patna High Court Cr.Misc. No.48294 of 2014 (3) dt.22-06-2015 2/2 the court of Learned Chief Judicial Magistrate, Gaya stands rejected.
However, if petitioners surrender in the court below and seek regular bail, their regular bail application shall be considered on its own merit without being prejudiced by this rejection order.
