JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.

The prosecution case is that petitioner purchased articles from the informant worth Rs. 8, 52,000/- and issued cheque of Rs. 11,45,128/- but subsequently the cheque got bounced.

It is submitted by learned counsel for the petitioner that issue has been settled between the parties and petitioner is ready to make payment of Rs. 8,52,000/- to the informant in three equal installments within a period of three months by submitting a draft of the said amount before learned Court below.

Learned counsel for the informant submits

Patna High Court Cr.Misc. No.41172 of 2015 (3) dt.30-10-2015 2/2 that informant is ready to accept the offer of the petitioner and on receiving payment of Rs. 8, 52,000/- within a period of three months, he will file appropriate application before learned Court below for withdrawal/compromise of the petition. The supplementary affidavits have been filed to that effect by the petitioner and the informant.

Considering the present stand of the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for four months on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali(Tilkamanjhi) P.S. Case No. 741 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional anticipatory bail of the petitioner will be confirmed by learned Court below on deposit of draft of Rs. 8, 52,000/- in favour of the informant which will be released to the informant by learned Court below. It is expected from the informant to file appropriate application for compromise/withdrawal of the petition before learned Court below within a period of ten days of receiving of the draft of Rs. 8, 52, 000/-.
