JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-10-2015 Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 376, 313, 420, 34 of the Indian Penal Code.
The prosecution case is that the informant was being enticed away by co-accused Amit Kumar who physically exploited her on promise of marriage and got her pregnancy terminated. It is alleged against this petitioner that petitioner being mother of co-accused Amit Kumar took signature on the plain paper on the pretext of informant getting married with Amit Kumar. One day the informant heard Amit Kumar talking to her mother about the planning to kill the informant then informant escaped from the house of Amit Kumar and lodged the present case.
It is submitted by learned counsel for the petitioner that thrust of accusation is against co-accused Amit
Patna High Court Cr.Misc. No.41105 of 2015 (2) dt.07-10-2015 2/2 Kumar and petitioner has been roped in the present case because she is mother of Amit Kumar.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the thrust of accusation against Amit Kumar and the petitioner being lady, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 111 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
