JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-B)a/26/35 of the Arms Act.
The prosecution case is that when the police, on information that petitioner has concealed one country made rifle near the platform of Airtel tower, raided the place when the petitioner escaped from the scene but other person was apprehended who named the petitioner.
It is submitted by learned counsel for the petitioner that recovery can not be treated from the possession of the petitioner.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with
Patna High Court Cr.Misc. No.41112 of 2015 (2) dt.08-10-2015 2/2 Fatehpur P.S. Case No. 229 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Gaya. With the observations above, the application stands disposed off.
