JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 This is an application for grant of anticipatory bail in connection with Shankarpur P.S. Case No. 91 of 2018, disclosing offences under Sections 341, 323, 307, 379, 379, 34 of the Indian Penal Code.

Prosecution story is that while the informant was coming by a motorcycle, a person was dashed by him received simple injury, but on hulla, the petitioners and several other accused persons assembled there and assaulted the informant by lathi, danda and causing injury to him.

Submission of learned counsel for the petitioners is that no specific allegation has been attributed against the

Patna High Court CR. MISC. No.20645 of 2019(2) dt.08-05-2019 2/2 petitioners and it further appears that the occurrence took place due to the accident caused by the informant.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st, Madhepura, in connection with Shankarpur P.S. Case No. 91 of 2018 8, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
