Petitioner seeks bail in Bakhtiarpur P.S. Case No. 75/2016, registered for the offences punishable under Sections 368, 364, 365 and 363 of the Indian Penal Code. Allegation is of kidnapping of informant's son by petitioner on the pretext of providing him education. It has been submitted that petitioner has falsely been implicated in this case. Petitioner is step-son of the informant and he has no concern with the informant's son and this case has been lodged by the informant after lapse of 23 years. Petitioner has no criminal antecedent. He is in custody since 16.05.2018.

No.65693 of 2018 (2) dt.06-11-2018 2/2 Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 75/2016, subject to the conditions:

(1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2.) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3.) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
