Public Prosecutor for the State assisted by learned counsel for the informant.

Trial court has reported that trial of the petitioner has already commenced. It is informed on behalf of the informant that two prosecution witnesses have already been examined. Petitioner happens to be husband of the deceased and earlier his prayer for bail was rejected by this court vide order dated 1.3.2016 passed in Cr. Misc. no. 5307/2016 taking into consideration the materials collected during investigation.

Again, I am not inclined to release the petitioner on bail and his prayer for bail in connection with Sessions Trial no. 268/2016 arising out of Hajipur Town P.S. case no. 351/2015 stands rejected. However, if the trial of the petitioner is not concluded

Patna High Court Cr.Misc. No.46460 of 2016 (3) dt.30-11-2016 within five months from the date of receipt/production of a copy of this order, petitioner may renew his prayer for bail before the learned trial court itself.
