The petitioner seeks bail in Madhubani Town P.S. Case No. 534/2015, registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code. It is submitted that the petitioner is not named in the FIR. Name of the petitioner figured in the case during course of investigation. The seizure list of Madhubani Town P.S. Case No. 29/2016 attached with the record of this case to show that the mobile recovered from the possession of the petitioner belongs to the informant of the present case. It is further submitted that no IMEI number has been written in the seizure-list nor the informant disclosed IMEI number of his mobile. The petitioner is in jail

Patna High Court Cr.Misc. No.55098 of 2016 (3) dt.27-02-2017 since 21.03.2016. He has already remained in jail for about 11 months.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. Case No. 534/2015.
