JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 417/448/341/379/427/506 of the Indian Penal Code. The prosecution case is that the petitioner came variously armed entered into the premises of the informant, robbed the articles and damaged the vehicle of the informant. It is submitted by learned counsel for the petitioner that the informant is running coaching institute and the petitioner paid Rs.30,000/- as coaching fee but neither the coaching was provided nor money was returned to the petitioner. He further submits that on the same day the informant lodged other case being Kankarbagh P.S. Case No.188 of 2015 with same accusation

Patna High Court Cr.Misc. No.41670 of 2015 (2) dt.08-10-2015 2/2 wherein the petitioner has been granted anticipatory bail by the learned Sessions Judge, Patna. Learned counsel for the petitioner further submits that except the cases lodged by the informant the petitioner is not accused in any other case.

Considering the nature of dispute and with the same accusation other case has been lodged wherein the petitioner has been granted anticipatory bail, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Kankarbagh P.S. Case No.189 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
