The petitioner seeks bail in Phulwariya P.S. Case No. 91/16 registered under Section 395 of the Indian Penal Code. It has been submitted on behalf of the petitioner that except that there is alleged recovery of one mobile from the possession of the petitioner nothing has come against the petitioner and the petitioner has not been put on the T.I.P. It has further been submitted that the IMEI No. of the mobile recovered from the possession of the petitioner does not tally with the IMEI No. of the mobile mentioned in the F.I.R. and the petitioner is in custody since 12.06.2016.
Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail and stated that the petitioner has got

Having heard both sides and in view of the facts stated above and the fact that the petitioner has not been named in the F.I.R. and he is in custody since 12.06.2016, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rahul Kishore, Judicial Magistrate 1st Class, Begusarai in Phulwariya P.S.
