This writ petition has been filed for quashing of the notice dated 06.03.2020 issued by the respondent no. 3, whereby the petitioner has been informed that the secured assets would be appropriated by the duly appointed Executive Magistrate on any convenient date.
It appears from the counter affidavit filed on behalf of the respondent / Bank that the proposal offered by the
Patna High Court CWJC No.6220 of 2020(5) dt.06-11-2020 2/2 petitioner has been accepted by the Bank.
In that view of the matter, nothing remains to be adjudicated in the present petition.
In case the petitioner requires any further extension of time or any modification in the proposal, he would be well advised to approach the bank authorities and the bank shall consider such prayer keeping in mind that the secured assets is a residential house and that the intention of the petitioner to make good the loan appears to be apparent form his conduct.
The writ petition stands disposed of with aforesaid observation.
