Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 414 of the Indian Penal Code and Section 11(i)(a)(d) of the Animal Cruelty Act, registered in connection with Pipra P.S.Case No. 283 of 2021. The police seized a vehicle bearing registration no. BR05GC2336. Some cattle were recovered therefrom. The driver Md. Tasobar was arrested and in his statement the name of the petitioner has figured.

The learned counsel for the petitioner has submitted that he is merely an owner of that vehicle and has no concern with the consignment loaded thereon.

Considering the above facts and circumstances, let

No.22002 of 2022(2) dt.29-09-2022 2/2 the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S.Case No. 283 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. If the learned court below finds that the petitioner is arrayed in any other case except the present one and the case disclosed in paragraph no.3 of the anticipatory bail petition as Barauli P.S.Case No. 234 of 2021, his bail bond shall stand cancelled.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
