Petitioners apprehend their arrest in Khanpur P.S. Case No.143 of 2018, registered under Section 307 and other sections of the Indian Penal Code.

The informant named the four petitioners and others and alleged that the accused persons abused him and took him to their Darwaza. Sanjeev Kumar assaulted the informant with farsa on his head. Sanjay Rai, petitioner no.3, is alleged to have assaulted the informant with iron rod which hit on his hand. Rinku Devi, petitioner no.2, is alleged to have assaulted the informant with garasa on his head. There is no allegation of assault against Ravin Rai, petitioner no.1 and Ram Vilash Rai, petitioner no.4.

Patna High Court CR. MISC. No.24563 of 2019(2) dt.16-04-2019 2/2 Learned counsel for the petitioners submits that there is a counter version being Khanpur P.S. Case No.142 of 2018. The informant got only two wounds on the head but injuries are simple in nature. There is a case and counter case from the side of the petitioners also. Petitioners' side also sustained injuries. Having considered the facts that both sides entered into scuffle and there is case and counter case, on account of assault made by Rinku Devi, petitioner no.2, one injury was found on head but no injury on hand was found on account of assault made by Sanjay Rai, petitioner no.3 and the fact that there is no allegation of assault against Ravin Rai, petitioner no.1 and Ram Vilash Rai, petitioner no.

4, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur in connection with Khanpur P.S. Case No.143 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
