1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Amas Police Station Case No. 289 of 2024, dated 26.08.2024, disclosing offences punishable under Sections 126(2)/115(2)/118(2)/109/352/3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, as per the First Information Report, is that on 25.08.2024 in the evening, the petitioner, along with other co-accused persons, abused the wife of the informant and the petitioner assaulted the wife of the informant on her head by means of tangi.

Learned Counsel for the petitioner submits that both the parties are neighbour and the occurrence has taken place on a trivial issue of parking of the tractor of the petitioner in front of the house of the informant. Referring to injury report (Annexure 2), learned Counsel submits that the injury caused to the wife of the informant is simple in nature, caused by hard and blunt substance; whereas the allegation is that the petitioner assaulted her by tangi, which is a sharp-cutting weapon.
5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the nature of allegation and the fact that injury caused to the wife of the informant is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Amas Police Station Case No. 289 of
