The petitioners apprehend their arrest in a case registered under sections 363, 366(A)/34 of the Indian Penal Code. The informant made allegation that Sanjit Kumar alias Laila kidnapped his minor daughter for the purpose of marriage. When the informant went to make complaint with the petitioners and others, they are alleged to have abused him. The victim appeared and made her statement under section 164 Cr.P.C. in which she disclosed that these two petitioners who are mother and sister-in-law of Sanjit Kumar called her and thereafter Sanjit Kumar kidnapped her but the victim made her statement under section 164 Cr.P.C. in which she disclosed that she has
Patna High Court Cr.Misc. No.49379 of 2014 (2) dt.09-04-2015 married with Sanjit Kumar.
Considering the fact that the petitioners are mother and sister-in-law of Sanjit Kumar and it appears that the victim was in love with Sanjit Kumar, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, (West), Muzaffarpur in connection with Paroo P.S. Case No. 13 of 2013, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
