Petitioner is in custody in connection with G.R.No.197 of 2020 arising out of Rafiganj P.S.Case No.47 of 2020 for the offence under Sections 30(a) of Bihar Prohibition and Excise Act.

Counsel for the State would submit that the petitioner is accused in Excise matter, having past criminal record, as such the release of the petitioner is not conducive in ensuing Assembly Election of 2020.

Considering the aforesaid fact, the petition is disposed of with a direction to the court below to release the petitioner on appropriate terms and conditions after declaration of the final
