The petitioners seek bail in Buxar (Mah.) P.S. Case No. 73/2018 (POCSO P.S. Case No. 52/2018), instituted for offences under Sections 341, 323, 504, 506 and 377/34 of the Indian Penal Code read with Section 6 of POCSO Act. Learned counsel for petitioners has submitted that petitioners are father and brother of the main accused, namely, Ganesh Gond.
It is alleged in the written report that on the date of occurrence, daughter of informant, aged about 5 years, was playing. In the meantime, co-accused Ganesh Gond called her in his house and committed unnatural sex with her. It is alleged
Patna High Court Cr.Misc. No.69998 of 2018(2) dt.03-12-2018 2/2 that when the informant complained the parents of Ganesh Gond with regard to same, they became angry and misbehaved with her.
In this manner, there is specific allegation against Ganesh Gond. These petitioners are father and brother of Ganesh Gond.
Petitioners are in custody since 14.09.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ 1stcum-Special Judge, POCSO Act, Buxar in connection with Buxar (Mah.) P.S. Case No. 73/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
