1. The Petitioner seeks quashing of the order dated 30.09.2013 by which the Ad hoc Additional Sessions Judge, 1st, Katihar, in Sessions Trial No.452 of 2013 arising out of Korha P.S. Case No.53 of 2013 has rejected the application of the Petitioner for release of the Opposite Party No.3 in his favour and instead directed her release in favour of the Opposite Party No.2.

2. None appears on behalf of the Petitioner.

3. However, counsel for the Opposite Party No.2 submits that now the Opposite Party No.3 is living with the son of the Petitioner, who is her husband.

4. Be that as it may, since the case has been mentioned for out of turn hearing, the application is disposed off with direction to the Court below to summon the alleged victim, record her statement and thereafter release her on her own surety since now she is major, if she has not been released already.
