The petitioner seeks bail in Special Case No. 9240 of 2018 arise on out of Phulwari Sharif Police Station Case No. 793 of 2018, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The petitioner is said to have been in possession of 20 litres of mahua wine, when he apprehended by the Police. It is submitted on behalf of the petitioner that he has no criminal antecedent.

Learned counsel for the petitioner submits that if he is again implicated in similar type of offence, the Court may consider the cancellation of his bail, if allowed in the present case.

Patna High Court Cr.Misc. No.70309 of 2018(2) dt.04-12-2018 2/2 Considering the nature of accusation, this application is allowed.

Let the petitioner, Ravi Kumar, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of the learned Special Judge, Excise, Patna in Special Case No. 9240 of 2018 arise on out of Phulwari Sharif Police Station Case No. 793 of 2018 registered under Section 30(a) Bihar Prohibition and Excise Act-2016.
