JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-02-2022 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered in connection with Jogapatti P.S.Case No. 346 of 2020 for the offences punishable under Sections 147, 341, 323, 324, 447, 325, 307, 354B of the Indian Penal Code. As per prosecution case, there is land dispute between both the parties. A scuffle took place and several

Learned counsel for the petitioner submits that there is land dispute between the parties and both the sides have sustained injuries. There is general and omnibus allegation against the petitioners. Both the parties amicably settled their dispute and a compromise petition has been filed. Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner, above named, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Jagapatti ( Nawalpur) P.S Case No. 346 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
