2. The petitioner seeks bail in connection with Dumra P.S. Case No.462 of 2023 registered for the offence under Sections 413 and 414 of the Indian Penal Code.

3. As per the prosecution case, it is a case of recovery of stolen motorcycle.

Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case. He next submits no independent witness of seizure and petitioner was neither apprehended at the spot nor the said motorcycle is of theft property. Similarly situated co-accused person has already been granted bail by this Court through Cr.

Patna High Court CR. MISC. No.25056 of 2024(3) dt.19-04-2024 2/2 Misc. No.15864 of 2024 on 19.03.2024. Petitioner is a man of clean antecedent and he is in custody since 23.09.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances of the case, let the petitioner, above named, be directed to be released on bail in connection with Dumra P.S. Case No.462 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi.
