Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State. The petitioner seeks bail in Warisaliganj P.S. Case No. 317 of 2019, registered for the offence punishable under Section 386, 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on 22.09.2019 petitioner along with Dilip Yadav and one unknown having variously armed came on horse and demanded rangdari of Rs. 20,000/- and fired in the air. When patrolling party reached there, they fled away on bike leaving their horse.

Patna High Court CR. MISC. No.19929 of 2020(3) dt.25-08-2020 2/2 It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. No incriminating article has been recovered from the place of occurrence. Similarly situated co-accused Dilip Yadav has been granted anticipatory bail by this court vide order dated 24.01.2020 passed in Cr. Misc. No. 74550 of 2019. Petitioner is in custody since 04.01.2020.

It appears that petitioner has got criminal antecedent and there are six cases pending against him.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
