The petitioner has prayed for a direction for his appointment as a Notary.

Mr. Singh, learned State Counsel with reference to the counter affidavit submits that in the process of selection the marks obtained by the petitioner was found to be below the last person selected. He submits that the appointment was made of such of the Advocates who obtained 10 marks but since the petitioner has obtained only 8 marks hence he was not appointed as a Notary.

Taking note of the submission made by the counsel

Patna High Court CWJC No.475 of 2014 (2) dt.26-06-2015 for the State as well as the fact that the statement made in the counter affidavit has not been controverted by the petitioner who received its copy on 3.4.2015, no case for indulgence is made out.

The writ petition is dismissed.
