Petitioner apprehends his arrest in Garhpura (Begusarai) P.S. Case No. 59 of 2014 registered under sections 406, 409, 419, 420, 467, 468 and 471 of the Indian Penal Code. The Branch Manager made allegation that some account holders made allegation of illegal withdrawal of money from their account. An enquiry is held and it has been found that the petitioner who is clerk in the bank has withdrawn Rs. 1455000/- from the accounts of different persons. It appears that the petitioner used to stay in the branch and use his user I.D. card and withdrew Rs. 49000/-. It is further alleged that after thorough inquiry the petitioner was found

No.49302 of 2014 (2) dt.07-04-2015 2/2 to have been withdrawn Rs. 14,54,000 /- from the account of different persons and Rs. 2,47000/- in the name of Kunwar Hazra Learned counsel for the petitioner submits that petitioner is assistant in the State Bank of India, Garhpura Branch The wife of the petitioner filed Mahila Thana Jahanabad P.S. Case No. 39 of 2014 in which she alleged that the informant stayed in the house of the petitioner and committed rape with her and in retaliation the branch manager has lodged this case. It appears that the Branch Manager has lodged the case after through inquiry that petitioner being the assistant of State Bank of India, Garhpura Branch withdrew Rs. 1500000 from the different accounts of the customers and thereafter fled away from the branch.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail. The same is rejected.
