KUMAR ORAL ORDER 30-11-2018 Heard learned counsel for petitioner, learned counsel for the informant as well as learned counsel for the State. Petitioner, who is in custody, seeks bail in connection with Buxar (Town) P.S. Case No. 261 of 2018 registered for the offences punishable under Sections 302, 307, 120(B), 34 of the Indian Penal code and Section 27 Arms Act. Informant has alleged that while he was coming on his Jeep with his father, the railway crossing was closed, as such he had to stop his vehicle and thereafter F.I.R. named accused Rameshwar Singh and Kanchan Singh fired from their pistol which hit his father and he also received firearm injury and thereafter he saw that Chitranjan Singh, Ajay Singh and Jagmohan Singh were also present there with arms. His father died while being taken to hospital.
Patna High Court Cr.Misc. No.68459 of 2018(2) dt.30-11-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. Petitioner is not named in the F.I.R. It has been further submitted that similarly placed co-accused have been granted bail by coordinate Bench of this Court in Cr. Misc. No. 43755 of 2018 and Cr. Misc. No. 44363 of 2018 vide order dated 23.07.2018 and 04.09.2018 respectively. Petitioner is in custody since 21.08.2018.
Learned counsel for the informant has vehemently opposes the prayer for bail of the petitioner. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (Town) P.S. Case No. 261 of 2018.
