The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Buxar (Town) P.S. Case No. 51 of 2025, lodged on 09.02.2025, under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per the prosecution, total recovery of 315 litres of foreign liquor has been made from a Tata Intra Vehicle, which is the subject matter of the present case.

4. Learned Counsel for the State submits that the apprehended persons have disclosed that the said act has been

5. From perusal of the record it transpires that antecedent of the petitioner is not clean. There are two criminal antecedents of identical nature pending against the petitioners.

6. Considering the fact that there is direct allegation made by co-accused, which is not only confession rather corroboration, and criminal antecedents of the petitioner, the prayer for anticipatory bail of the petitioner is hereby rejected. (Dr. Anshuman, J) Mkr./- U T
