The petitioner seeks bail in a case instituted under Sections 392 of the Indian Penal Code.
The prosecution story, in brief, is that on the alleged date of occurrence, when the informant was returning from Dhawai and was going for Bandhan Bank, after collection of money from villagers near Pachgharva bridge, three persons came on motorcycle and on the point of pistol snatched Rs. 24,000/- and a bag containing calculator, Group Register, Deposit Register etc and mobile also and fled away.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.09.2016. The charge sheet has
Patna High Court Cr.Misc. No.54814 of 2016 (2) dt.09-01-2017 2/2 been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the basis of confessional statement of co-accused. He has not been put on T.I.P. to ascertain his implication in the present case. There is no recovery of any incriminating article from the possession of the petitioner. It is further submitted that the petitioner may be released on bail after completion of six months in custody i.e. from 17.09.2016.
On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R. but he has got a criminal antecedents.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of six months in custody i.e. from 17.09.2016, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Nawanagar P.S.
