JUSTICE BIRENDRA KUMAR ORAL ORDER 21-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 47/47(a)/53(a)/53(b)/54 of the Bihar Excise (Amendment) Act, 2016.

Country-made liquor was allegedly recovered on 23.08.2017. The villagers informed that petitioner had threw the bag on seeing the police party and fled away. Considering the fact that there is substantial material against the petitioner, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period

Patna High Court Cr.Misc. No.17543 of 2017 (2) dt.21-04-2017 2/2 of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram/Successor Court in connection with Sasaram Town Police Station Case No.962 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall file undertaking at the time of furnishing of the bail-bond before the Court-below that they would not indulge themselves in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
