KUMAR ORAL ORDER 28-11-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner, who is in custody, seeks bail in connection with Sarmera P.S. Case No. 64 of 2018 registered for the offence punishable under Sections 307, 323, 34 of the Indian Penal Code and Section 27 of Arms Act.

Informant is the mother of injured victim has stated that while her son was sleeping at the Dalan, petitioner and one other accused entered and fired upon her son, as a result of which he sustained injury in his leg.

The nature of injury is grievous, as such I am not inclined to grant bail to the petitioner at this stage. However, after completing one year of custody the petitioner would be at liberty to renew his prayer for bail.
