JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2017 At the very out set it has been submitted by the learned counsel for the petitioners that during the pendency of this application, petitioner No.1- Ram Shankar Singh has been arrested, and as such he wants to withdraw the anticipatory bail application on behalf of the petitioner no.1. Anticipatory bail of petitioner no.1- Ram Shankar singh, is dismissed as withdrawn.

The petitioner- Urmila Devi is apprehending her arrest in connection with Bhagwanpur P.S.Case No. 159 of 2016, registered under Section 304(B)/34 of the I.P.C. she is mother-inlaw of the deceased. It has been submitted that the victim died due to blast of gas cylinder. She was taken to hospital for treatment and the

Patna High Court Cr.Misc. No.16526 of 2017 (3) dt.11-04-2017 2/2 informant and other members were also with her, but they have falsely implicated the petitioner.

Heard learned Additional P.P. also.

Having heard both sides and considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. However, the petitioner is directed to surrender before the court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
